On Tuesday, a New York appeals court judge denied President-elect Donald Trump's request to postpone his criminal sentencing on Friday for the case involving paying hush money to a porn star prior to the 2016 election.
Judge Gesmer denied Trump's request shortly after holding a hearing, and a day after Judge Merchan refused to delay the sentencing.
Trump's legal team contended that he was entitled to a pause in the case due to a U.S. Supreme Court decision from the previous year stating that presidents possess presumptive criminal immunity for actions performed in their official capacity.
Trump's attorneys argued that he would suffer irreparable harm and have his constitutional rights violated if he were to be sentenced 10 days before his second term.
Gesmer was skeptical of those claims during the hearing.
Merchan has stated that he is unlikely to give Trump any jail time and is inclined not to order him to serve any probationary sentence or pay any fine in the case.
In her ruling, Gesmer denied movant's application for an interim stay after careful consideration of the submitted papers and the oral argument.
Last year, Trump was found guilty of 34 felony charges for falsifying records related to the $130,000 payment made by his lawyer, Michael Cohen, to Stormy Daniels, an adult film actress.
Daniels was paid by Cohen on the eve of the 2016 presidential election in exchange for her silence regarding a supposed one-time sexual encounter with Trump in 2006.
Trump denies having had sex with Daniels.
