A new court motion revealed that attorneys for President-elect Donald Trump are seeking to prevent his scheduled sentencing in a New York criminal case involving hush money later this week.

Trump's legal team filed an appeal to Manhattan Supreme Court Judge Juan Merchan's decision to reject their request to dismiss the criminal case, as stated in a public motion made available on Monday.

The motion proposes that the sentencing for Merchan should be automatically put on hold until the appeal is resolved, which is scheduled for Friday. If Merchan does not agree, he should grant Trump an immediate stay of the proceeding until the outcome of the appeal, which could take months to resolve.

In May, Trump was found guilty of 34 felony charges for falsifying business records concerning a 2016 payment to Stormy Daniels, a porn star, made shortly before the presidential election that year.

Last week, Merchan stated that he was not inclined to sentence Trump to jail in the case and would impose a sentence that does not include either probation or a fine.

Merchan rejected arguments to dismiss the case because of a U.S. Supreme Court ruling that presidents have immunity from criminal prosecution for official acts while in office and due to the Constitution's Supremacy Clause.

Trump's legal team filed a motion to halt the unlawful sentencing in the Manhattan D.A.'s investigation on Monday, according to spokesman Steven Cheung.

Cheung stated that the Supreme Court's historic decision on Immunity, the state constitution of New York, and other established legal precedent require that this baseless hoax be promptly dismissed.

On January 20, Trump will be inaugurated as president for his second non-consecutive term in the White House.
