During his 2024 campaign, former President Donald Trump maintained his political operation by walking a financial tightrope. The guilty verdict in a Manhattan hush money case added to his long list of legal challenges, resulting in a loss of over $100 million in donor money.

Experts in campaign finance believe that a combination of innovative fundraising methods and strategic legal moves have helped the Trump campaign overcome a financial crisis, which had raised doubts about his ability to compete in the election.

Over the past three years, Trump has spent approximately $90,000 per day on legal costs, taking advantage of a loophole in campaign finance law since leaving the White House in 2020.

Trump has utilized a network of political action committees (PACs) to transfer donor funds to his leadership PAC, Save America, which is mainly used to cover his legal expenses. Unlike his official campaign, these groups are not bound by the same restrictions imposed by the FEC.

"Leadership PACs have been a problem for years, if not decades," said Saurav Ghosh, director of campaign finance at the Campaign Legal Center. "These funds are often used by candidates and officeholders as a slush fund to pay for whatever they want without much oversight."

It is common for politicians to use political donations for legal purposes. Recent filings reveal that President Joe Biden utilized contributions from the Democratic National Committee to pay lawyers in a classified documents case. Additionally, U.S. Sen. Bob Menendez, who is running for reelection and facing trial for bribery, has spent $2 million in campaign funds on legal services.

According to FEC rules, these practices are permitted when they pertain to a candidate's qualifications to hold office. However, experts advise that using political contributions for personal legal issues, such as Trump's New York business fraud case, is not allowed.

Ghosh stated that the FEC and Congress are unlikely to take enforcement action against Trump, as both parties gain from the practice.

"Ghosh stated that Trump is the most noticeable example due to his actions on an unprecedented scale, but the issue is that everyone does it."

Despite receiving over 40 complaints about Trump's misuse of campaign funds, the FEC has not launched any investigations.

Trump's legal costs are expected to increase with three more criminal cases pending trial dates. However, a surge of megadonor support and small-dollar donations after the May 30 guilty verdict has helped alleviate the financial strain on his campaign. In the week following the trial, Trump's team and the RNC reported raising $141 million in May, with millions more donations coming in after the verdict.

The Trump campaign is reportedly utilizing a new wave of funding as part of a strategy to exploit his legal battles and attract wealthier donors, according to experts.
