  • The Michigan secretary of state's office is investigating a political action committee backed by Elon Musk.

  • No state laws were broken by the PAC, according to legal experts.

An investigation into a political action committee backed by billionaire Elon Musk is underway in Michigan as they attempt to gather voter data.

According to Forbes, Musk, the CEO of Tesla and SpaceX, has stated that he founded and financed the America PAC, which is backing former President Donald Trump.

The committee has been obtaining comprehensive voter data from residents of Michigan and other crucial states after individuals submit their personal information through a section on the PAC's website labeled "register to vote."

Upon clicking on the "register to vote" tab on America PAC's website, users in Michigan can enter their ZIP code, address, and phone number. After submitting this information, they are directed to a page that says "thank you" and asks them to complete the form below to finalize the voter registration process. However, as of Sunday afternoon, there was no other form to complete below the words "thank you."

The Michigan secretary of state's office stated that every citizen should be aware of how their personal information is being used by PACs, particularly if an entity claims it will assist people in registering to vote in any state, including Michigan.

The Department is reviewing the activities of the America PAC, a federal political action committee, to determine if there have been any violations of state law. If any potential violations are found, they will be referred to the Michigan Attorney General's office.

CNBC initially reported on the group's efforts and how the site does not directly register people to vote for those with an address in a swing state.

Since the PAC registered with the Federal Election Commission in May, the links on their website were functioning properly, but now they admit that they are not.

A new website will be launched by the group in the upcoming weeks, as explained by the person who wished to remain anonymous to discuss confidential matters.

Neither a spokesperson from the America PAC nor Musk responded to requests for comment.

Michigan's Secretary of State and lead election official, Jocelyn Benson, is a Democrat who has been a vocal opponent of election-related misinformation, including statements made by former President Donald Trump.

At least twice this year, the Republican National Committee has filed lawsuits against Benson and other Michigan Democrats, as per legal records.

Unclear if any laws broken

No laws in Michigan have been broken by the America PAC.

Barbara McQuade, a former U.S. attorney for the Eastern District of Michigan, stated in an email on Sunday that she was not convinced that the PAC was breaking any state laws, as she was not aware of any laws being broken.

In an email to CNBC, Mary Massaron, a partner at law firm Plunkett Cooney, expressed reservations but did not specify if the PAC had violated state regulations.

According to Massaron, it is concerning for any candidate or PAC-funded project to intentionally withhold information or a link to register to vote when someone inquires, as this could indicate that they may vote for the opposing candidates.
