The North Carolina Attorney General's Office announced on Monday that it is investigating a political action committee founded by billionaire Elon Musk after receiving a complaint from the state election board regarding the PAC's collection of personal data while failing to fulfill its promise to assist users in registering to vote.

The Michigan secretary of state's office has announced a new inquiry into Elon Musk's America PAC following a CNBC report that the group was asking website users in battleground states for personal data, including their ZIP code, full address, and phone number, under the guise of helping them register to vote without actually doing so.

Users of America PAC's site in states not considered competitive in the 2024 election were directed to voter registration pages for their state.

The America PAC is backing Donald Trump in the 2024 election against Kamala Harris, who is the presumptive Democratic nominee.

SpaceX CEO and X owner Musk has stated that he established the PAC and financed it.

A spokeswoman for North Carolina AG Josh Stein stated on Monday that their office is aware of the issue with the PAC's website and is currently investigating it.

She stated that her office is investigating the matter but has not yet initiated a formal investigation.

Stein is the Democratic nominee for governor in North Carolina.

On Sunday, a spokeswoman for Michigan Secretary of State Jocelyn Benson stated that her office is examining America PAC to ascertain if the organization has breached state law.

Benson's spokeswoman stated that day that every citizen should be aware of how their personal information is being used by PACs, particularly if an entity claims it will assist people in registering to vote in Michigan or any other state.

Despite claims that they would be assisted with voter registration, users in Michigan, North Carolina, Georgia, and Wisconsin were not helped by America PAC on its website.

Neither Musk nor an America PAC representative responded to requests for comment on Monday.

On Monday, users in North Carolina who visited the America PAC website were unable to register to vote after submitting their personal information, despite the website indicating that they could.

After CNBC published its first story on America PAC's voter registration links, longtime political activist David Wheeler filed a complaint with the North Carolina Board of Elections.

According to a CNBC review of a complaint, Wheeler alleged that America PAC has violated state laws.

"Wheeler wrote that the America PAC is falsely claiming to be conducting an online voter registration campaign, but in reality, they are gathering voter data and are illegally keeping it in violation of NC laws."

Wheeler's PAC, American Muckrakers, has spent money opposing the election bids of Republican candidates, including former Rep. Madison Cawthorn and Rep. Lauren Boebert.

The North Carolina State Board of Elections did not respond to Wheeler's complaint against America PAC.

On Monday, a spokesman for Pennsylvania Secretary of State Al Schmidt, a Republican, stated to CNBC that American PAC had not submitted an application to utilize the state's online voter registration system.

The Department of State's secretary's office has granted permission to both partisan and non-partisan organizations to connect with an API for securely submitting voter registration applications, provided they undergo rigorous security testing and agree to the Department's Terms of Use.

The Department is not aware of any steps taken by America PAC to submit electronic voter registration applications for processing.

No response was given when inquired about the potential investigation or legal consequences resulting from America PAC's failure to submit an application for the program.

Since early July, AdImpact reports that America PAC has spent more than $100,000 on digital ads aimed at Pennsylvania voters.
