On Friday, a Pennsylvania federal judge returned a lawsuit against Elon Musk and his political action committee to state court, aiming to stop the $1 million daily giveaway to registered voters.

The case was removed from state court in Philadelphia and returned to federal court a day after the suit filed by District Attorney Larry Krasner was requested by CEO Musk and his America PAC.

On Monday, a lawsuit was filed by Krasner against Musk and the PAC, alleging that they were operating an illegal lottery by providing a random cash prize to registered voters in Pennsylvania.

Krasner may obtain a quick order in the Philadelphia Court of Common Pleas to block America PAC from awarding any more $1 million prizes to registered voters in the state, as per Friday's ruling.

In his ruling to remand the case to the Court of Common Pleas, U.S. District Judge Gerald Pappert disregarded Musk's lawyers' claims that the lawsuit should be handled in Philadelphia federal court due to the suit's reference to the upcoming federal presidential election.

According to Pappert, federal question jurisdiction is not based on a plaintiff's motivations for filing suit, but rather on whether the legal issues arising from the claims stem from federal or state law.

The judge ruled that Musk and the PAC had not demonstrated any federal law that needed to be resolved in favor of the DA to prove their state-law claims.

The District Attorney's argument that America PAC and Mr. Musk's attempt to remove the case from state court in Philadelphia was unlawful is supported by the ruling.

An attorney representing Krasner's office, John Summers, stated that they are waiting for the state court to schedule a hearing to consider an emergency request to halt the $1 million lottery.
