The high court ruled on July 1 that former presidents have "presumptive immunity" for their official acts while in office and "absolute immunity" for certain core executive functions. The majority of the court also questioned or shut down specific parts of Smith's case.

Last week, Smith's office stated in a court filing that it was not opposed to Trump waiving his attendance at the arraignment on the revised indictment.
