  • TSMC has refuted claims that it is being probed by the U.S. Commerce department over alleged ties with Chinese tech giant Huawei.
  • A day after a report claimed that a TSMC chip was found in a Huawei product, a new statement has been made.

The U.S. has denied that it was investigating its dealings with Huawei, a Chinese tech company, after reports emerged that its chips were discovered in the company's products.

On Wednesday, a company spokesperson informed CNBC that TSMC is a law-abiding company and is fully committed to adhering to all applicable rules and regulations, including export controls.

Last week, The Information reported that the Commerce Department was investigating whether TSMC had been producing AI or smartphone chips for Huawei, potentially violating U.S. export regulations.

The TSMC spokesperson stated that they proactively communicate with the U.S. Commerce Department about the matter in the report and are not aware of TSMC being the subject of any investigation at this time.

In May 2019, Huawei was put on a U.S. trade blacklist due to national security concerns.

Since mid-September 2020, TSMC, the world's largest contract chip manufacturer, has not provided chips to Huawei.

One of TSMC's chips was discovered in a Huawei product, prompting the chip maker to notify the Commerce Department of possible export violations.

According to anonymous sources, a report claimed that a Huawei product was disassembled by tech research firm TechInsights, which discovered a TSMC chip within its multi-chip system.

CNBC has not received a response from TechInsights regarding its public report and findings.

TSMC refused to provide additional information regarding the allegations in the Reuters article.

Since Huawei released a smartphone with a 5G chip, there has been renewed attention on the company's access to advanced semiconductor technology, which the U.S. had sought to restrict.

Neither the U.S. Commerce Department nor Huawei provided a comment on the request.

TSMC's shares fell 1.4% on Wednesday.
